The Assam government has now approached the Supreme Court in the case involving Congress leader Pawan Khera. The state government has challenged the Telangana High Court’s decision, which granted Pawan Khera one week of transit anticipatory bail. The Assam government argues that a review of this order is necessary and has therefore filed a petition in the Supreme Court. Additionally, the government has appealed to the Chief Justice of India (CJI) Justice Surya Kant for an urgent hearing of the matter on Wednesday.
This case is linked to an FIR registered in Assam regarding alleged comments made against Riniki Sharma, the wife of Chief Minister Himanta Biswa Sarma. In connection with this case, the Telangana High Court had provided relief from arrest to Pawan Khera by granting him transit anticipatory bail for one week.
The High Court order also stated that during this period, Pawan Khera would file an application in the relevant court and cooperate with the investigation. The court clarified that the bail was granted with certain conditions and the accused must fully cooperate in the investigation.
Now, the Assam government is challenging this decision in the Supreme Court, demanding a legal re-examination, which has once again brought the case into the spotlight.
During the hearing of Pawan Khera’s petition, the Telangana High Court, while granting him one week of transit anticipatory bail, also set some important conditions. Justice K. Sujana clarified in the order that the petitioner is given one week to file an application for regular bail in the relevant court and will be granted limited relief during this period.
The court also stated that if an arrest situation arises during this time, Pawan Khera would have to be released on bail only upon presenting a personal bond of one lakh rupees along with two sureties of the same amount.
Additionally, the court made full cooperation in the investigation process mandatory. According to the order, the petitioner must be available for questioning whenever called by the investigating officer and will not be allowed to avoid any type of investigation. The court also clarified that Pawan Khera cannot travel out of the country without prior permission from the court.
The order further mentioned that within the stipulated one-week period, he must apply for regular bail in the concerned court in Assam. Also, being a public figure, he must refrain from making any such public statements related to this case that might potentially affect the investigation or legal process.
